TERMS AND CONDITIONS OF PURCHASE

Welcome to Bonbon Collections Inc., a Canadian company incorporated under the Business Corporation Act QLR v S-31.1. All users of this site agree that access to and use of this site is subject to the following terms and conditions and any other applicable law. The use of this site constitutes your approval. If you do not agree with these terms and conditions, please do not use the Bonbon Collections website Inc.

This document constitutes a contract (the “Contract”) between you (“you”, “your”, “your”) and Bonbon Collections Inc. (“Bonbon Collections”, “we,'' “our”) regarding the terms and conditions associated with ordering and receiving our products (“Products”) which are offered to you through the  «bonboncollections.com» website, any subdomain or other related mobile platform (the “Website”, the “Service”). You must review the following terms and conditions of purchase before using the Service.

By accessing the Website or using the Service, you agree to all the terms and conditions described in this Agreement. At any time, you may cancel this Agreement by ceasing to use the Service as described in this Agreement.

DELIVERY

Inaccessible areas

Currently, Bonbon Collections does not deliver across Canada. As such, Bonbon Collections reserves the right to cancel an order if your region is one of the inaccessible locations for delivery.

Terms of delivery

Bonbon Collections generally uses third parties to ship its Products; therefore, all purchases of Products are governed by a shipping contract which provides that the title and the risk of loss relating to these Products are transmitted to you when the Products are delivered to you. Once the Products are delivered, their condition and consumption are at your own risk, and you are solely responsible for handling, storing, using,and consuming the Products appropriately and safely. Bonbon Collections is not responsible for any action or omission on the part of such third parties and is not responsible for any delay or loss of any kind that occurs when an order is in or under the control of a third party

Shipping dates and times are estimated, and actual shipping dates and times may change due to weather and other factors, some of which are beyond our control. In the event of circumstances beyond our control that affect our ability to deliver the Products to you on your scheduled delivery date, we will attempt to deliver your Products to you as soon as possible.

A delivery notice will be sent to the email address in your Bonbon Collections account indicating the possible delivery days. Bonbon Collections will not be held responsible if the box is not retrieved at the location you have indicated in your account. It is your duty to ensure that delivery is made in a sufficiently secure location. We are committed to providing you with the necessary proof of delivery to support this.

The Products shall be deemed delivered when the Product is delivered to the place indicated in accordance with the delivery instructions specified in your order. We assume that anyone present at the address specified in the delivery instructions is authorized to receive the order on your behalf. If no one is present at the address indicated in your delivery instructions, we will leave the package unattended at the address or location you specify. It is your responsibility to provide us with clear and complete delivery instructions.

It is your responsibility to inspect all Products you receive from us at the time of delivery for damage or other problems. You are solely responsible for determining the state of the Products you receive. In the event that a Product is not as per expectation at the time of its delivery, please advise us within 24 hours and we will deal with this situation in accordance with our return and refund policy.

Once your Products are received and inspected, you must immediately freeze all Products or follow the pieces of advice in our storage and usage policy.

Any degradation of the Products will be your responsibility once delivery is completed. If you are unable to retrieve your order, it is your responsibility to find a solution so as not to let the freshness of the Products deteriorate. You must take into account the current season in your area and outside temperatures to plan your deliveries as well as the recovery of your box.

For any damaged orders, we invite you to contact customer service directly at boutique@bonboncollections.com as soon as you receive your box.

ORDER, EXCHANGE RATES, TAXES AND PAYMENT OPTIONS.

All prices are in Canadian dollars. Some of our products are not taxable, some are. We accept all of the following payments: credit card and prepaid card. Orders purchased on www.bonboncollections.com are sent securely to our order desk where they are reviewed. Once the order is verified and fully paid, it will be processed and delivered. All sales are final and no refunds can be made.

Customers agree to pay for the goods and services purchased through the Bonbon Collections website and recognize that buying goods or services online is equivalent to buying from a physical store.

Bonbon Collections reserves the right to change its prices at any time during the subscription. In this case, Bonbon Collections will publish, prior to the price change, notices on its website or through any other mode that Bonbon Collections will choose, in order to inform you of the changes.

HEALTH RELATED INFORMATION

Information accessible on this Site is for information only and is not intended to be a substitute for professional medical advice. Bonbon Collections does not endorse or warrant the validity of any such health related statements contained on the Site or any such information contained in third party sites referenced in the Site. Information is general in nature and may be helpful to some persons but not others, depending upon their personal medical needs. ALLERGEN POLICY  

All of our products are manufactured in our dedicated 10 priority allergen free facility (i.e. gluten, dairy, nuts, peanuts, eggs, soy, sesame, mustard, seafood and sulphites), which we call the Happiness Factory ! 

We control the production process from A to Z and the highest quality assurance standards are monitored by food experts. 

Each ingredient used has its own allergen declaration certificate directly from the manufacturer. We do not accept any ingredient that has been manufactured in the same production line or that is declared to contain one of the ten allergens present in the facility. 

Although Bonbon Collections follows the strictest procedures, with the most rigorous and professional methods and controls, there is no such thing as zero risk. We require our suppliers to provide us with their allergen-free certifications and select them carefully to avoid the risk of contamination. Nevertheless, these risks can occur and are unfortunately beyond our control. Therefore, we cannot guarantee 100% that our products will not cause allergic reactions. By choosing to purchase and consume our products, you accept these risks of contamination beyond our control & you acknowledge their existence so that Bonbon Collections, its directors, officers, employees, suppliers and insurers will not be held responsible for any damage that may result. 

Please be aware that we periodically test our products for the ten priority allergens for which professional tests exist.

LIMITATION OF LIABILITY

TYPOGRAPHICAL ERRORS

In the event that a Bonbon Collections product is incorrectly listed at an incorrect price, Bonbon Collections reserves the right to refuse or cancel all orders placed from the product listed at the incorrect price. Bonbon Collections reserves the right to refuse or cancel such orders even if the order has been confirmed and loaded to your credit card account. In case the order has already been invoiced to your credit card and your order is cancelled, Bonbon Collections agrees to give credit to your account by reimbursing your credit card at the value of the price error.

LIMITATION

These terms and conditions apply to you when you access the site and/or complete the registration or purchase process. These terms and conditions, or any part thereof, may be terminated by Bonbon Collections without prior communication at any time, for any reason. The provisions relating to copyrights, trademark, denial, limitation of liability, indemnity and miscellaneous, will survive any judgment.

NOTIFICATION

Bonbon Collections may send you the notification by email, a general notification on the site, or by any other reliable method to the address you have provided to Bonbon Collections.

MISCELLANEOUS

The use of this site will be governed in all respects by the laws of the Province of Quebec, Canada, without regard for the choice of the provisions of the law, and not by the U.N. Convention of 1980 on contracts for the international sale of goods. You agree that the court and the place of appointment in any legal proceedings directly or indirectly arising out of or concerning this site (including, but not limited to the purchase of Bonbon Collections’s products) will be conducted in provincial or federal courts located in Montreal, Quebec. Any cause of action or claim relating to the site (including, but not limited to, the purchase of Bonbon Collections’s products) must be commenced within one (1) year after the claim or cause of action has arisen.

Bonbon Collections’s failure to insist on or impose strict enforcement of these terms and conditions will not be interpreted as a waiver of any provision or right. Neither the course of conduct between the parties nor the commercial practice will act to modify any of these terms and conditions. Bonbon Collection may assign its rights and duties under this agreement to any party at any time without prior communication.

USE OF THE SITE

Harassment in any way or form on the site through emails, the blog, or through obscenity or abuse is strictly prohibited. You may not download, distribute or edit any defamatory, obscene, threatening, intrusive, abusive, illegal or objectionable content that may constitute or encourage a crime, or violate the rights of any party or that may cause liability or violate any law. You may not download commercial content from the site or use the site to solicit others to join or become members of any other online commercial service or other organization.

SAFETY

Bonbon Collections works to protect the security of your personal information during transactions through our secure system. Bonbon Collections employees do not have access to your credit card information, as it is encrypted immediately when a transaction is completed. Only the transaction management company, with which Bonbon Collections deals with, receives its encrypted information. Other personal information collected by Bonbon Collections is used to ship your order through the carriers, to be able to contact you in case of need or to make you benefit from all the opportunities and activities offered by Bonbon Collections. It is possible at any time to request that your information be removed from our database.

DENIAL OF PARTICIPATION

Bonbon Collections does not and cannot review all communications and materials reported to or created by users accessing the site, and is in no way responsible for the content of such communications and materials. You acknowledge that by allowing you the right to view and distribute the content written by the user on this site, Bonbon Collections acts simply as a passive conduit for such distribution and undertakes no commitment or responsibility for any content or activity on this site. However, Bonbon Collections reserves the right to block or remove communications or materials it determines to be (a) abusive, defamatory, or obscene (b) fraudulent, misleading, or deceptive, (c) in copyright infringement, trademark or intellectual property right or (d) injuring and unacceptable to Bonbon Collections in its sole discretion.

INDEMNIFICATION

You agree to guarantee, defend and keep Bonbon Collections harmless, as well as its managers, managers, employees, agents, investors and suppliers (collectively, the "service providers") against any losses, expenses, damages and costs, including reasonable attorneys' fees resulting from any breach of these terms and conditions or any activity related to your account (including negligent or unjustified conduct) by you or any other person accessing the site using your Internet account.

THIRD PARTY

In order to provide added value to our visitors, Bonbon Collections can link to sites operated by third parties. However, even if the third party is affiliated with Bonbon Collections, the latter has no control over these linked sites, which have separate practices in collecting private information, independent of Bonbon Collections. These linked sites are only for your convenience and therefore you access them at your own risk.
